GROUP PRIVACY POLICY
- The ARDEX Australia Group
The Ardex Australia Group comprises the following companies;
- ARDEX Australia Pty Ltd (ABN 82 000 550 005) (ARDEX Australia) , a leading supplier of building materials and products, specialising in high-quality construction materials for substrate preparation, levelling floors, the fixing of natural stones and ceramic tiles and other surfacing materials. ARDEX Australia offers innovative products of outstanding quality and optimal environmental friendliness, as well as providing training and support services for their application.
- D.T.A. (Australia) Pty Ltd (ABN 26 007 291 054), a leader in the manufacture, importation and distribution of quality tools, profiles and machinery for the wall and floor market.
- Nexus Adhesives Pty Ltd (ABN 61 121 120 036), a market leader in the manufacture and distribution of flooring adhesives as well as carpet backing compounds throughout Australia and New Zealand.
- Wedi Australia Pty Ltd (ABN 76 639 539 754), a specialist and partner in waterproof and directly tileable building boards, customisable shower systems and other modular design systems made for tile and stone finishes.
Each of the companies referred to above and any other company which is now or which later becomes a related body corporate of ARDEX Australia and which operates a business in Australia together comprise the ARDEX Australia Group. Any reference to the ARDEX Australia Group in this Statement includes each of those companies and related bodies corporate individually so far as the context allows.
This Statement describes how your personal information is collected and handled by each member company of the ARDEX Australia Group.
- Open and transparent management of personal information
This Privacy Policy (Policy) sets out the ARDEX Australia Group’s policy on the management of personal information. The ARDEX Australia Group are fully committed to ensuring the proper management and use of all personal information they collect and handle in accordance with applicable Australian privacy laws, including the Australian Privacy Principles under the Privacy Act 1988 (Cth) and, to the extent it applies, the Global Data Protection Regulation (EU) 2016/679.
- Application
This Policy covers personal information collected in Australia by the ARDEX Australia Group. The Policy does not apply to information (including personal information) collected by third parties, such as payment gateway providers, or through third party websites linked to this website. Those third parties are subject to applicable privacy laws and their own privacy policies (if any).
ARDEX Australia may review and update this Policy from time to time by posting the updated Policy on its website, on the websites of other Ardex Australia Group members and on other platforms and portals as it thinks fit (together “Websites”). You are taken to have agreed to the updated Policy if you continue to place orders for ARDEX Australia Group products or services, or continue to visit or browse any ARDEX Australia Group Website after the updated Policy is posted on that Website.
- Personal information
Personal information is information or an opinion about an identified individual or an individual who is reasonably identifiable.
- Collection and purpose
The purpose for collection depends on the relationship an ARDEX Australia Group company has with you, including so that it can provide you with the products and services that you order, and keep you informed of products and services that may be of interest to you. Personal information about you is used only for the purpose for which it is submitted or other secondary purposes in accordance with applicable privacy laws. Information collected about you can also be used in a de-identified form (i.e., a form in which an individual cannot be identified) to assist an ARDEX Australia Group company generally in improving its business, products and services to customers.
(Types of personal information collected) The type of personal information collected about you will depend on the relationship an ARDEX Australia Group company has with you. The ARDEX Australia Group collects and holds personal information about (but not limited to):
- users and potential users of our Websites and any online platforms or applications
- business associates and potential business associates, and their employees and contractors
- individuals we deal with in the course of providing services to our users
- suppliers and their employees and contractors
- employees, prospective employees and contractors.
The type of personal information collected about you may include:
- first name, last name, role/trade/profession, email address, telephone number, location and address
- financial information, such as account numbers, credit card details
- information about you that you provide to an ARDEX Australia Group company through feedback forms, surveys, or other forms that you complete and send to any ARDEX Australia Group company
- other contact details, occupations, payment details, employment history, education and qualifications, testimonials, feedback and other information which assists us in conducting business, providing and marketing our services, and meeting our legal obligations.
(Other information collected) The ARDEX Australia Group collect other information that may not identify you but is provided by you to the ARDEX Australia Group.For example, this information may include your browsing preferences, IP address, internet service provider, the country from which you are accessing a Website, the third party website that has directed you to a Website, the search term you use (if you come to the website via a search engine), date and time of your visit to the Websites that you visit, and the files that you download from the Websites.
(How information is collected) Information (including personal information) may be collected in a number of ways, including:
- information provided by you to the ARDEX Australia Group verbally or in any written form (e.g. when you attend one of ARDEX Australia’s events or contact customer service)
- personal information about you through your conduct on our Websites, our online platforms and portals, via support services, email, telephone
- information provided by you through social media channels
- information provided by you to a third party where that third party is authorised to provide the ARDEX Australia Group with such information
- information provided by your computer or device in the course of visiting an ARDEX Australia Group Website (e.g., cookies) or browsing an electronic communication from the ARDEX Australia Group (e.g., email)
- by or on behalf of your employer if you are employed by any of our suppliers or contractors.
(Cookies) The ARDEX Australia Group uses cookies on its Websites to distinguish you from other users, to provide you with a better experience when you browse our Websites and also so we can improve our website. “Cookies” are a small piece of data sent from a website and stored in a user’s web browser while the user is browsing that website. Every time the user loads the website, the browser sends the cookie back to the server to notify the website of the user’s previous activity. These cookies allow us to increase your security by storing your session ID and are a way of monitoring single user access. These data are generally aggregated and provided to us to assist us in analysing the usage of our Websites.
You can choose to disable cookies on your computer by updating your browser setting, but you do need to be aware this may cause a website not to function properly.
(Use of information collected) The ARDEX Australia Group use personal information collected for a number of specific purposes depending on whose personal information it is:
- for customers: The ARDEX Australia Group uses information collected to carry out orders placed for products and services; deliver products and services to the correct location; invoice customers for products and services; set up trade accounts and deal with payment defaults (including to obtain a credit report to assess a customer’s suitability for credit or to notify any customer default to credit reporting agencies); facilitate payment of products and services; provide after-sales services; exercise rights under the applicable Conditions of Sale in relation to orders for products and services; and keep customers informed of products and services that may be of interest to the customer.
- for website visitors: The ARDEX Australia Group use information collected to provide an improved and positive website experience for Website visitors (including to resolve Website issues). Information provided by Website visitors when visiting an ARDEX Australia Group Website allows the ARDEX Australia Group to recognise the visitor as a customer; customise Website services, content, and advertising; measure promotional effectiveness; help ensure that Website visitor accounts security is not compromised; and follow up with Website visitors that wish to find out more information about ARDEX Australia Group products or services or place orders from the ARDEX Australia Group.
- For suppliers, contractors and retailers: The ARDEX Australia Group use information collected to explore business opportunities for the provision of ARDEX Australia Group products (or parts of them) and services along the supply chain and through distribution channels, and to exercise rights under the applicable contracts with suppliers, contractors and retailers.
- for employees and prospective employees: The ARDEX Australia Group use information collected for recruitment, human resources and employment-related purposes.
- Anonymity
You can deal with the ARDEX Australia Group anonymously if it is lawful and practicable to do so. If you prefer, you can use a pseudonym in place of your real name. In cases where the ARDEX Australia Group deals with you in relation to the supply of products or services or the provision of financial or credit information it will be impracticable for the ARDEX Australia Group to deal with you either anonymously or by pseudonym. However, you may wish to remain anonymous or use a pseudonym if you are making a general inquiry about ARDEX Australia Group products or services.
- Security
The ARDEX Australia Group takes protection of personal information seriously. The ARDEX Australia Group will take reasonable steps to secure personal information against misuse, interference, loss and unauthorised access, modification or disclosure.
Personal information may be stored in different ways, including paper, electronic and online forms, and using online data storage service providers. All personal information collected by the ARDEX Australia Group is stored at secure premises, including a computer network that is secured by firewalls, passwords and anti-virus protection. ARDEX Australia Group personnel are required to comply with privacy and data policies and procedures. Personal information is only provided to third parties for the sole purpose of providing products and services to the ARDEX Australia Group as set out in section 9 (Disclosure) of this Policy. Those third parties also have an obligation to keep personal information secure in accordance with their privacy policies and applicable privacy legislation.
Once personal information is no longer required by the ARDEX Australia Group or is no longer required to be kept by law, the ARDEX Australia Group will take reasonable steps to destroy the information or ensure that the information is de-identified.
- Direct marketing
The ARDEX Australia Group engages in direct marketing practices in accordance with the law. Information (including personal information) collected is used to identify particular products, services or special offers that the ARDEX Australia Group believes may be of interest to you. The ARDEX Australia Group may then contact you (such as by telephone, mail, email or other communications) to let you know about these offers and opportunities.
The ARDEX Australia Group will only continue to engage in these direct marketing activities with your consent. In any case, you will be provided with the opportunity to opt out of receiving such information in the future. For email communications, there is a simple “unsubscribe” feature that you can utilise at any time. You can also at any time request that you no longer receive any marketing materials and information from the ARDEX Australia Group by contacting the ARDEX Australia Group’s privacy officer using the details set out in section 12 (Contact us about privacy questions and complaints) of this Policy.
- Disclosure
The ARDEX Australia Group may disclose personal information to and among its member companies and third party suppliers and contractors to the extent it is necessary for them to provide products and services to the ARDEX Australia Group, or if required by law, a court or an enforcement agency that has power to require disclosure of such personal information.
- Quality
The ARDEX Australia Group will ensure, to the extent reasonably practicable, that personal information collected, used or disclosed is accurate, up-to-date, complete and relevant. If the ARDEX Australia Group become aware that any of the personal information they hold is inaccurate they will take prompt steps to update their records so that the personal information collected, used or disclosed is accurate, up-to-date, complete and relevant.
- Access and correction
Subject to verification of your identity, if the ARDEX Australia Group hold personal information about you then you may make a request to access, update or correct this personal information at any time.
The ARDEX Australia Group will give you access to your personal information that they hold subject to a few exceptions. The ARDEX Australia Group will not give you access to your personal information that they hold if:
- the ARDEX Australia Group reasonably believe giving you access would pose a threat to the life, health and safety of any individual;
- giving access is likely to unreasonably impact the privacy of others;
- your request is frivolous or vexatious;
- the information relates to existing or anticipated legal proceedings between you and the ARDEX Australia Group and that information would not be discoverable in legal proceedings;
- giving access would prejudice any negotiations between the ARDEX Australia Group and you;
- giving access would be unlawful;
- giving access would likely prejudice taking appropriate action where there is reason to suspect unlawful activity or misconduct of a serious nature; or
- giving access may prejudice enforcement activities, or a commercially sensitive decision-making process.
The ARDEX Australia Group will provide written reasons for any refusal to give access.
If there is a substantial amount of personal information that needs to be accessed, the ARDEX Australia Group may charge you a fee to recover their reasonable costs in supplying you with the information you requested. The ARDEX Australia Group will notify you of the amount of the fee when they respond to the request but before they give access to the information. There is no fee to make a request for access to your personal information.
If you hold an online account with the ARDEX Australia Group, you may access and correct your personal details at any time by logging into your online account. Alternatively, access and correction requests should be made in writing to the ARDEX Australia Group’s privacy officer using the details set out in section 12 (Contact us about privacy questions and complaints) of this Policy.
The ARDEX Australia Group will aim to respond to written requests for access and correction of personal information within 15 business days after a request is received by the ARDEX Australia Group. Where the ARDEX Australia Group are unable to give access or correct the information (as applicable) within 15 business days, they will notify you of the reason for the delay and provide an indication of when they expect to give access or correct the information (as applicable).

The ARDEX Australia Group will:
- acknowledge receipt of a complaint within 10 business days; and
- aim to resolve a complaint within 45 business days.
It may not always be possible to resolve a complaint within 45 business days. If the ARDEX Australia Group are unable to resolve a complaint within 45 business days, they will notify you of the reason for the delay and provide an indication of when ARDEX Australia or another member company of the ARDEX Australia Group expects to resolve the complaint.
