Terms & Conditions
1.ARDEX Australia Pty Ltd; ABN: 82 000 550 005; of 20 Powers Rd, SEVEN HILLS, NSW 2147 Australia; is the organiser of this trade promotion lottery.
2.The Promotion is a lottery game of skill titled ARDEX Has Your Back (the Promotion).
3.The Promotion period is 5pm AEDT on 18 September 2023 until 18 October 2023 for the shirt giveaway and until 30 October for the prize giveaway.
4.The Promotion has two parts: a) shirt giveaway AND b) a prize giveaway for the best submissions across Threads, Instagram, Facebook, YouTube and Tik Tok.
5. This Promotion covers legislation across every state and complies with the general conditions set out within:

Conditions of Entry
6. Promotion participants (Participants) are defined as individuals who take part in one of two ways (or both):

- Enter their details into the form on the website for the free shirt
- Tag @ardexaustralia into a reel, story or short video wearing the shirt
7. The conditions of entry comply with legislation across every state and include:

- The Promotion is free for Participants to enter
- The Promotion is open to Australian residents only
- Participants of the Promotion must meet requirements:
- 6 to order the shirt
- 6 to enter the giveaway
- Quantity of entry:
- Participants can only enter 4a once only
- Participants can enter 4b with as many unique entries daily as desired
- ARDEX Australia staff, or their family members, are not eligible to enter the Promotion
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Conduct of the Lotteries
8. The top five finalists for 4b will be posted at 5pm AEST on 31 October 2023 on ARDEX Australia’s Instagram page and contacted via direct message.
10. The conditions of the Promotion comply with the authorities listed in 5.
Details of Prize 4a
11. There is one prize only in 4a – An ARDEX Tshirt. Every effort will be made to ensure that the requested size is fulfilled.

12. 5 x Ridge Ryder Thermo Cooler/Warmer 12 Litre Ute Fridges
13. Prizes from 4a will be posted immediately via standard Australia Post
14. Prizes from 4b will be delivered to the winners via Australia Post. Every effort will be made to ensure prizes are claimed. Unclaimed prizes will go to their local stockist after 3 months of unclaimed prizes. Any deliveries from the stockist to the winner will be at the cost of the winner.
15. The Promotion and the associated Terms & Conditions are publicly available via the Internet on the ARDEX Australia website, as stipulated by each state’s requirements for trade promotion lottery.
16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant and (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion.
17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; and (f) use of a prize.
18. All entries become the property of the Promoter. By entering the promotion, each entrant consents that the Promoter may use and disclose the personal information supplied by them to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. Any personal information obtained by the Promoter will be handled in accordance with the Privacy Act 1988 (Cmth).
